Safety, Products and Liability: A Legal Blog

Welcome to my blog. This blog is dedicated to helping anyone who is currently in the midst of a liability issue. A few years ago, my daughter contracted listeria due to poorly packaged food. She, thankfully, was okay, but we still took her case to court. I want all families who have been affected by liability issues to understand their rights, so I decided to start this blog. My beautiful daughter is now 17 and preparing to start uni next year. I have three younger children as well and an amazing husband. Thank you for reading my blog. Please share my posts if they help you!

Key Considerations for Family Lawyer Selection

by Liesanne Martin

Separation spousal support, child custody, and property settlements are some of the areas of family law that have to be settled in the family court. With business lawyers unable to take up these cases due to conflict of interest and limited knowledge of family law, family lawyers become a crucial part of the proceedings. In such periods of distress as divorce, individuals are faced with the additional worry of finding the best lawyer to represent them. The personal nature of the information one has to share with a family lawyer also makes the selection process daunting for people who seek to have their matter resolved in the family court. Here are three considerations that will guide you in making the most appropriate decision regarding family lawyer selection.

Experience. The lawyer who takes up a family law matter needs to demonstrate sufficient working knowledge of other parts of the law. This is because family law is expansive, as it borrows from tax law, criminal law, bankruptcy, and property law. It usually helps when the lawyer is familiar with the ins and outs of the family court and the Family Law Act. Such familiarity, gained from years of experience, can be the difference between winning and losing a court case.

Personality. The lawyer needs to be understanding and sympathetic without being agreeable at all times. This is important in creating professional interaction based on mutual respect, thus allowing the client to divulge details that would be reserved and enabling them to get the best advice. The lawyer's personality is also important in the interactions that they will have with third parties as they attempt to build a strong case or defense. The client's financial planner or accountant, for example, will need to liaise with the lawyer as they attempt to align financial goals with the family law issue at hand. The lawyer should have good communication and interpersonal skills in order to get the most out of the relationships that may influence the case.

Cost. You should always strive to get a lawyer whose fees are within your budgetary constraints. The consultation fees and the subsequent payments given to the family lawyers make up the costs associated with contracting the lawyer. You can opt for a free consultation as a way of cutting down costs while also getting a preview of the lawyer's abilities. This will allow you to make the decision to hire the lawyer or seek assistance elsewhere. Referrals can also be effective in finding the best family lawyer to handle a family law matter.
